Foley was born in Dubuque, Iowa, to John Foley and Ellen Fitzgerald on August 7, 1857.  John Foley was born in London and his mother, Ellen, in Ireland.  The couple came to the United States, first to Iowa and then on to California, in 1867, settling in the vicinity of Marysville.  From there, D. Foley also published, "Foley's Yosemite Souvenir & Guide,  a comprehensive overview of the glories of Yosemite," including places to stay, where to eat, what to see, and how to travel.  The Guide was illustrated with both his own photographs and those of other photographers, including George Fiske.
